Overview

Welcome to BreweeGo.

Throughout these Terms of Service, the terms “we,” “us,” and “our” refer to BreweeGo.

BreweeGo operates this website and online store, including all related information, content, features, tools, products, and services made available to you (collectively, the “Services”).

Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer our Services to you.

These Terms of Service (“Terms”) explain your rights and responsibilities when accessing our website, purchasing our products, or otherwise using our Services.

Please read these Terms carefully. By visiting our website, creating an account, placing an order, or otherwise using our Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you should not access or use our Services.

Section 1 – Eligibility, Access and Accounts

By using our Services, you confirm that you are at least the age of majority in your country or region of residence or that you have permission from a parent or legal guardian.

To access certain features or make a purchase, you may be required to provide information including your:

  • Name.

  • Email address.

  • Telephone number.

  • Billing address.

  • Shipping address.

  • Payment information.

You agree that all information you provide will be accurate, complete, and current.

You are responsible for maintaining the security and confidentiality of your account credentials and for activity conducted through your account.

You must notify us promptly if you believe your account has been accessed or used without your authorisation.

You may not sell, assign, transfer, or license your account to another person.

Section 2 – Our Products

We make reasonable efforts to accurately describe and display our products.

However, product colours, appearance, proportions, packaging, and other visual characteristics may vary due to:

  • Screen and device settings.

  • Photography and lighting conditions.

  • Product improvements.

  • Manufacturing variations.

  • Packaging updates.

  • Other factors outside our reasonable control.

We do not guarantee that the appearance of a product on your screen will perfectly match the physical product you receive.

Product descriptions, images, specifications, prices, and availability may be changed or updated without notice.

We reserve the right to modify, discontinue, or limit the sale of any product where reasonably necessary. We may also limit the quantity of products available to an individual, household, geographical area, or jurisdiction.

Nothing in this section limits your rights if a product does not match its description or otherwise fails to meet a guarantee under applicable consumer law.

Section 3 – Product Use and Safety

You are responsible for reading and following all product instructions, warnings, care information, and safety guidance supplied with your BreweeGo product.

Our products should only be used for their intended purpose.

When using a portable coffee maker or related product, you must take reasonable care when handling hot water, hot beverages, pressure, electrical components, rechargeable batteries, and other components that may present a safety risk if improperly used.

You should:

  • Keep the product away from children unless supervised by a responsible adult.

  • Inspect the product before use.

  • Follow all cleaning, charging, storage, and operating instructions.

  • Stop using the product if it appears damaged or operates abnormally.

  • Avoid modifying, dismantling, or attempting unauthorised repairs.

  • Use only compatible accessories and power sources specified in the product instructions.

  • Allow hot components to cool before cleaning or handling them.

BreweeGo is not responsible for damage caused by misuse, unauthorised modification, failure to follow instructions, improper cleaning, unsuitable accessories, or use for an unintended purpose, except where responsibility cannot lawfully be excluded.

If you believe your product is faulty or unsafe, stop using it and contact us at hello@breweego.com.

Section 4 – Orders

When you place an order with BreweeGo, you are making an offer to purchase the products selected in your order.

We may accept, reject, limit, or cancel an order where reasonably necessary, including because of:

  • Suspected fraud or an unauthorised transaction.

  • Incorrect pricing or product information.

  • Stock or availability issues.

  • Payment problems.

  • Suspected commercial resale.

  • Delivery restrictions.

  • Errors affecting the order.

  • A breach of these Terms.

Your order is not considered accepted until payment has been successfully processed and we have issued an order confirmation.

Please review your order carefully before submitting it.

Once an order has entered processing or fulfilment, we may be unable to change or cancel it.

If we need to change or cancel an order, we will attempt to contact you using the contact details supplied during checkout. If we cancel an order after payment has been processed, we will provide an applicable refund.

Returns, refunds, replacements, and exchanges are handled in accordance with our Refund & Returns Policy.

Products purchased from BreweeGo are intended for personal or household use unless otherwise agreed by us in writing.

Section 5 – Prices, Payments and Billing

Prices, discounts, promotions, and special offers may change without notice.

The price charged will generally be the price displayed at checkout when your order is submitted.

Unless otherwise stated, prices displayed on our New Zealand website are in New Zealand dollars.

Applicable shipping charges, taxes, duties, and other costs will be displayed or calculated during checkout where reasonably possible.

International customers may be responsible for customs duties, import taxes, brokerage fees, or other charges imposed by authorities or third parties in their destination country.

You agree to provide accurate, complete, and current billing and payment information.

By submitting a payment method, you confirm that you are authorised to use it and agree to pay all charges associated with your order.

Promotional offers may be subject to additional terms. If specific promotional terms conflict with these Terms concerning that promotion, the specific promotional terms will apply.

Section 6 – Shipping and Delivery

Orders are processed and delivered in accordance with our Shipping Policy.

Unless expressly stated otherwise, processing and delivery timeframes are estimates only.

Delivery may be affected by circumstances outside our reasonable control, including:

  • Carrier delays.

  • Customs processing.

  • Severe weather.

  • Public holidays.

  • Seasonal demand.

  • Transport or logistical disruptions.

  • Incorrect delivery information.

  • Events affecting local or international delivery networks.

Customers are responsible for providing complete and accurate shipping information.

Additional charges may apply if an order must be redirected or resent because the customer supplied incorrect or incomplete delivery details.

Nothing in this section limits any delivery rights or remedies available under applicable consumer law.

Section 7 – Returns, Refunds and Exchanges

Returns, refunds, replacements, and exchanges are governed by our Refund & Returns Policy.

Please contact hello@breweego.com before returning a product. Unless otherwise required by law, products returned without prior authorisation may not be accepted or processed.

Our store policies operate in addition to any non-excludable rights you may have under applicable consumer law.

Section 8 – Intellectual Property

Unless otherwise stated, the BreweeGo website and its contents are owned by or licensed to BreweeGo and are protected by applicable intellectual-property laws.

Protected content may include:

  • Trade names and trademarks.

  • Logos and brand elements.

  • Product names.

  • Graphics and illustrations.

  • Videos and audio.

  • Website designs and layouts.

  • Advertising materials.

  • Written content and product descriptions.

  • Slogans and marketing materials.

  • Other original content.

You may access our Services for personal and non-commercial use only.

Unless permitted by law or authorised by us in writing, you must not:

  • Reproduce or copy our content.

  • Download or republish substantial portions of our website.

  • Modify or create derivative works from our content.

  • Sell, license, or commercially exploit our content.

  • Scrape or systematically extract website information.

  • Use our branding in a way that suggests an unauthorised connection with BreweeGo.

All rights not expressly granted under these Terms are reserved.

Section 9 – Optional and Third-Party Tools

We may provide access to tools, applications, payment methods, integrations, or services operated by third parties that we do not directly control.

These services may be provided on an “as available” basis and may be subject to the third party’s own terms and privacy policy.

Your use of third-party services is at your discretion.

We are not responsible for third-party tools or services except to the extent required by applicable law.

New tools, resources, features, or functionality introduced through our website may also form part of the Services and be subject to these Terms.

Section 10 – Third-Party Links

Our Services may contain links to websites, applications, platforms, or services operated by third parties.

BreweeGo does not control these third-party services and is not responsible for their:

  • Content or accuracy.

  • Availability.

  • Products or services.

  • Security practices.

  • Privacy practices.

  • Terms or policies.

You should review the applicable terms and policies before interacting with or purchasing from a third party.

Any questions, concerns, or claims relating to a third party’s products or services should be directed to that third party.

Section 11 – Relationship With Shopify

BreweeGo’s online store is powered by Shopify, which provides the ecommerce infrastructure that enables us to offer our Services.

Purchases made through the BreweeGo store are transactions between you and BreweeGo.

Shopify is not the seller of BreweeGo products and is not responsible for our products, product descriptions, fulfilment, delivery, customer support, returns, or refunds.

To the extent permitted by applicable law, Shopify and its affiliates are not responsible for claims, losses, or liabilities arising directly from products purchased from BreweeGo.

Section 12 – Privacy

We collect, use, store, and disclose personal information in accordance with our Privacy Policy.

Because our store is powered by Shopify, Shopify may collect and process information relating to your access to and use of our Services.

Information may also be processed by providers involved in:

  • Payment processing.

  • Order fulfilment.

  • Delivery and logistics.

  • Analytics.

  • Marketing and advertising.

  • Customer support.

  • Website security and functionality.

Please review our Privacy Policy for further information.

Section 13 – Reviews, Feedback and Submissions

If you voluntarily provide BreweeGo with a review, photograph, video, suggestion, idea, comment, testimonial, or other content (“Feedback”), you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, display, distribute, and adapt that Feedback for purposes connected with operating, improving, and promoting our business and Services.

This licence is subject to applicable law and any specific agreement made between you and BreweeGo.

You confirm that:

  • You have the right to provide the Feedback.

  • Your Feedback is honest and accurately represents your experience.

  • Your Feedback does not violate another person’s rights.

  • Your Feedback does not contain unlawful, abusive, defamatory, obscene, deceptive, or harmful content.

  • Your Feedback does not contain malware or malicious code.

  • You have not falsely represented your identity or relationship with another person or organisation.

We may moderate or remove Feedback that violates these Terms or applicable law.

Section 14 – Errors, Inaccuracies and Omissions

Occasionally, information on our website may contain an error, inaccuracy, or omission relating to:

  • Product descriptions.

  • Product specifications.

  • Pricing.

  • Promotions or discounts.

  • Product availability.

  • Shipping costs.

  • Delivery estimates.

  • Other website content.

We may correct errors, update information, or cancel an affected order where reasonably necessary.

If an error affects an order you have already placed, we will take reasonable steps to contact you and provide an appropriate resolution.

Nothing in this section limits your rights under applicable consumer law.

Section 15 – Prohibited Uses

You may use our Services only for lawful purposes.

You must not use our Services to:

  • Violate a law or regulation.

  • Infringe our intellectual property or another person’s rights.

  • Engage in fraudulent, misleading, or deceptive conduct.

  • Harass, abuse, threaten, or defame another person.

  • Submit false information.

  • Transmit malware, viruses, or harmful code.

  • Collect personal information about another person unlawfully.

  • Send spam or unauthorised commercial communications.

  • Impersonate another person or organisation.

  • Interfere with our website’s security or operation.

  • Circumvent security measures or access restrictions.

  • Scrape or extract substantial portions of our website without authorisation.

  • Use our Services in a way that may harm BreweeGo, Shopify, our customers, or another person.

We may restrict, suspend, or terminate your access where we reasonably believe these Terms have been violated.

Section 16 – Automated Systems and Agents

Automated systems, bots, scraping tools, artificial-intelligence agents, or similar technologies must not interact with our Services in a way that:

  • Circumvents security measures or access restrictions.

  • Bypasses CAPTCHAs or robot-exclusion protocols.

  • Places an unreasonable burden on our systems.

  • Extracts protected content without authorisation.

  • Conceals or misrepresents the system’s automated nature.

  • Interferes with our website or other customers’ use of the Services.

We may limit or block automated access where reasonably necessary to protect our customers, website, intellectual property, and technical infrastructure.

  • Materially breach these Terms.

  • Engage in fraudulent or unlawful conduct.

  • Interfere with the operation or security of our Services.

  • Misuse our intellectual property.

  • Abuse our refund, returns, or chargeback processes.

Obligations or liabilities incurred before termination will continue to apply.

Sections intended by their nature to survive termination will remain effective after termination.

Section 18 – Disclaimer of Warranties

To the fullest extent permitted by law, our website and online Services are provided on an “as is” and “as available” basis.

Although we aim to provide accurate, secure, and reliable Services, we do not guarantee that the website will always be uninterrupted, error-free, completely secure, or available at all times.

Nothing in these Terms excludes, restricts, or modifies a consumer guarantee, warranty, right, or remedy that cannot legally be excluded under applicable consumer-protection law.

Section 19 – Limitation of Liability

To the fullest extent permitted by law, BreweeGo and its directors, employees, contractors, affiliates, agents, service providers, and licensors will not be liable for indirect, incidental, special, or consequential losses arising from your use of the Services or products purchased through the Services.

This may include loss of profits, revenue, savings, business opportunities, or data where such liability can legally be excluded.

Nothing in these Terms excludes, restricts, or modifies:

  • Liability that cannot legally be excluded.

  • Any mandatory consumer guarantee.

  • Any statutory right or remedy.

  • Liability for conduct for which exclusion would be unlawful.

Where applicable law provides you with mandatory consumer rights, those rights continue to apply.

Section 20 – Indemnification

To the extent permitted by law, you agree to indemnify BreweeGo and its affiliates, directors, employees, agents, contractors, licensors, and service providers against losses, liabilities, and claims arising from:

  1. Your material breach of these Terms.

  2. Your unlawful use of the Services.

  3. Your infringement of another person’s rights.

This section does not apply to the extent that a loss or liability was caused by BreweeGo or where the indemnity is prohibited by law.

Section 21 – New Zealand Consumer Rights

Nothing in these Terms is intended to exclude, restrict, or modify any right, guarantee, or remedy that cannot legally be excluded under New Zealand law.

This includes applicable rights under the:

  • Consumer Guarantees Act 1993

  • Fair Trading Act 1986

Where the Consumer Guarantees Act applies, products must be of acceptable quality, fit for their intended purpose, match their description, and be delivered within an agreed or reasonable timeframe.

Any additional guarantee, return period, or remedy offered by BreweeGo operates alongside your statutory rights.

Section 22 – Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent legally permitted or severed where necessary.

The remaining provisions will continue in full force and effect.

Section 23 – Waiver and Entire Agreement

If we do not immediately exercise or enforce a right under these Terms, that does not mean we have waived that right.

These Terms, together with our Privacy Policy, Refund & Returns Policy, Shipping Policy, and any other terms or policies published on our website, constitute the agreement governing your use of the Services.

Section 24 – Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

BreweeGo may transfer or assign its rights or obligations where permitted by law, including as part of a sale, restructuring, financing, or transfer of the business.

Section 25 – Governing Law

These Terms are governed by the laws of New Zealand.

Any dispute relating to these Terms or the Services will be subject to the applicable jurisdiction of the New Zealand courts, subject to any mandatory consumer rights or laws that apply where you live.

Nothing in these Terms removes any consumer-protection right that cannot legally be excluded.

Section 26 – Headings

Section headings are included for convenience only and do not affect the meaning or interpretation of these Terms.

Section 27 – Changes to These Terms

We may update these Terms from time to time to reflect changes to our Services, products, business practices, technology, or legal obligations.

The current version will be published on this page with an updated “Last updated” date.

Where required by law, we will provide appropriate notice of material changes.

Your continued use of the Services after updated Terms take effect constitutes acceptance of those Terms to the extent permitted by law.
